Businesses seek compensation over energy suppliers' commission

A class action claim against a number of energy suppliers is being set up by a specialist law firm on behalf of businesses, following claims that undisclosed commissions were paid to third-party brokers when gas or electricity contracts were arranged.

The failure of energy companies to tell their customers that brokers were paid the alleged undisclosed commissions means that this money could be claimed back by entitled businesses which used a broker service to find an energy deal.

London-based commercial and group litigation law firm Harcus Parker says it has seen evidence which suggests many suppliers may have paid commissions of between 2p and 3p/kWh of energy. In some cases this is believed to have been as high as 10p/kWh.

If this commission is not disclosed to the customer, and if the customer does not give fully informed consent, then they may be entitled to be paid a sum equal to the commission plus interest.

Additional claims could also be possible if the customer was led to expect that the broker would obtain the best price available in the market.
